Information of What, Where and How do i use the dynamic Digital Copyright Seal?

What is copyright?
Copyright is a legal property right giving the owner the exclusive right to copy the work; to issue copies to the public; to rent or lend the work to the public; to perform, show or play the work in public; to broadcast the work or to include it in a cable programme service or to make an adaptation of the work or to do any of the preceding things in relation to that adaptation.

If someone does any of the above, without the consent of the copyright owner then that someone is committing a primary infringement of copyright.
What sort of work is "copyrightable"?
Under the Copyright, Designs and Patents Act 1988, copyright subsists, subject to certain criteria, automatically by statute (without the need formally to register it in any centralised registry) in nine types of work and which can conveniently be divided into three categories:
   1) Original literary, dramatic, musical or artistic works.
   2) Sound recordings, films, broadcasts or cable programmes.
   3) The typographical arrangement of published editions.
Why should I use this service?
icreateditfirst can assist with establishing the criterion of priority. Register your work with us and we can "date stamp" it electronically and provide a record to assist in priority claims. The service also provides a place of storage for your work to which only you will have access. This provides a secure form of back up should you ever lose the original.
Can I change the timestamp given to my protected work?
No, you would not have the ability to change the timestamp given on upload to our server. The fact that no change is possible is a fundamental part of the service and means that you can subsequently assert ownership of copyright by establishing if not the date of creation of the work, at least by the date of registering it with us and thereby improve your chances that a court will accept the assertion.
Why should I trust this service?

icreateditfirst.com is hosted in the UK’s leading state-of-the-art data centre ensuring the highest levels of network performance, reliability and security. Our Service Provider, Infinitum Technologies, has systems in place to ensure the data security, access and privacy of the site.

Of course, it is not possible to absolutely guarantee that you will be able to access the service all of time, but we have adopted well recognised practices to ensure we deliver very high service levels. If and when access is not available all reasonable efforts will be made to ensure continuity of service within 24 hours.

We recognise that the data held by iCreateditfirst Ltd is of vital concern to our users. Everything reasonably possible will be done, including redundancy of hardware configurations and strong software backup strategies to ensure the availability of your data. Please note however that the nature of the majority of our users requirements mean that whilst guaranteed access is required, time critical access will not normally be required.

Are my files going to be safe and secure?
We recognise that the data held by iCreateditfirst Ltd is of vital concern to our users. Everything reasonably possible will be done, including redundancy of hardware configurations and strong software backup strategies to ensure the availability and security of your data.
When I buy from iCreateditfirst are my credit card details going to be kept safe?
Yes. Your personal information will be sent over an encrypted channel directly to the bank using secure communications designed to decrease the chances of Internet hacking. As is well known, no absolute guarantee can be given but we will use all reasonable endeavours and state of the art technology to ensure safety. In addition, iCreateditfirst keeps no record of your credit card details.
Is this service secure?
Yes. The moment you log in, all information is sent over an encrypted secure communications link, reducing the chances of security problems. One of the main security risks is represented by the security of a users password. Please keep your password safe and secure at all times.
Can I change my personal details?
Yes, Click here to change your personal information. Please note, once you have completed changing your personal details the system will log you out. This is so the system can update your personal records.

Why can't I change my security question?

You only have one chance to select a security question and answer, which is at registration time. This is to ensure that you and only you can always gain access to your records. If your password security has been compromised it is possible that an intruder can gain access to your account and change your password. This is when your security question becomes crucial.

If, however, you manage to forget or lose your security question/answer or you need to change these details please email Support Send us an email and explain your problem.

How do I protect my work, what is the process?
Protecting your work is simple. Follow these simple tasks to start protecting your work

   1. Registration – To create an identity with which we can associate your work.
   2. Purchase space for your work – Purchase either lifetime or yearly subscription space for your work
   3. Upload your file – So that we can take the file from your computer, store it on our secured server and give it a time stamp.
Why do I need to create an account?
You must create an account so that we can associate your work with your identity. Please ensure that the information provided is accurate, as it will represent the identity that is associated with your protected work. Failing to do so can result in complications around personal identity that can weaken your evidence in a copyright battle.
Why do I need to enter my personal details such as date of birth?
Personal details such as date of birth are used to help represent your identity. If information such as this is inaccurate, it can weaken your evidence in any copyright ownership battle. Your date of birth should be the same as published on your passport, driver’s licence or birth certificate, as this is the type of identity evidence required in a court of Law.

What is the purpose of the password?
This is to ensure that only you have access to your account.
Can I register work for somebody else?
Work that is registered by you should be associated with you and no-one else. If you have a friend who needs to protect their work, they should create an account of their own. Registering their work in your name is technically possible but not recommended.
What is the under 18 issue?
Persons under the age of 18 years cannot take or defend proceedings in an English court of law except through a Guardian and Next Friend.
Once I have purchased space for my work, when does it expire?
The lifetime product expires on your death. The subscription product expires one year from the date of purchase.
What happens if forget to renew my account?
The subscription product requires account renewal once a year - an email reminder from iCreateditfirst will ensure you know when to renew. If no action is taken then the account will lapse and you will no longer have access to your work. In addition, you will not be able to use our registration service to establish your ownership of copyright. At some time soon after your decision not to renew, iCreateditfirst will, at it’s sole discretion, delete the information held.
How will I know when to renew my account?
As long as your account information is up to date an email reminder from iCreateditfirst will remind you when you need to renew.
What do I do if I want to increase my account capacity?
With the subscription account, you will need to upgrade your registration. Click on 'Account capacity’ from the side menu, select a greater capacity, and follow the instructions. With the lifetime account, you can purchase space for additional individual works at any time, and these will last for your lifetime.
Will my work still be protected once I have upgraded my account?
(Subscription account only) Yes. All that will change is the amount of storage you have available.
Can I decrease my account capacity?
(Subscription account only) Yes. Annually at renewal time a smaller account capacity can be selected as appropriate.
Once I have protected my work is the expiry based on the date given to my work?
(Subscription account only) No. The expiry date is based upon an ‘Account Capacity’ purchase. Every time you increase or decrease your ‘Account Capacity’ the expiry date will be one year from then.
Can I transfer the timestamp to somebody else if I decided to sell or assign my copyright and the rights to somebody else?
No. This feature is not currently supported. It is possible that this feature could be in the next release. Please email us if you wish to have this functionality in the future. Feedback
Can I view sample uploaded work for guidence?
Yes. Click on the 'search' option from the menu, set the search criteria to 'SAMPLES' and click GO.
Would the printed timestamp of my registered work from the iCreateditfirst web site be sufficient as legal evidence?
No. Only the online timestamp version of your registered work would be valid in a court of law.
If I change a protected file, and upload it again, would the timestamp change or stay the same?
(Subscrition account only) The timestamp would change.
In the event of a copyright dispute over my work, would any members of iCreateditfirst be available to assist me, or be able to send full documents to me, as evidence that I did create it first?
You can print the documentation required in these circumstances. It is currently not part of the services offered to attend court with you, be an expert witness or attest to the efficacy of icreateditfirst.
icreateditfirst is a real time, online service that will permit the court of law access, with your consent, to view the validity of your registered works and timestamp.
icreateditfirst is bounded by our terms and conditions, which are available on the site. If the courts were to challenge the validity of our service, a representative from icreateditfirst would be made available.
If someone were to steal of copy my work, would iCreateditfirst be known as a 100% official copyright service, with enough evidence to prosecute?
Copyright applies automatically as soon as you have created your work. There is no legal requirement to do anything else. This means there is no such thing as an official copyright service (100% or otherwise).

The difficulty may come when your copyright is subsequently challenged. This is why some people post their work to themselves. A more reliable insurance policy may be depositing your work with a lawyer or a bank who can provide the two things that are required: a secure place of storage and a reliable timestamp

We at iCreateditfirst believe that we offer a service that is better than the above in terms of cost, reliability and convenience. Please note we provide a registration service only, which will give substantial evidence but no guarantee of your chances of successfully prosecuting anyone.

Do you post work back to yourself for copyright protection?
Posting work back to onesself is one of the most common methods to provide a degree of copyright protection. Posting work to onesself is simple and can be effective. In fact legal cases based on this method have won in a court of law.
You would seal the information that you want to copyright in an envelope and post it to yourself. When you receive the post-marked envelope, you would not open it: the post-marked date stamp is good evidence that your information existed in that form at that date.
The drawback is that you still have the responsibility of keeping the envelope safe. The moment the envelope is unsealed, lost or damaged all copyright protection from the original date will have been lost. Remember that no personal possession is ever safe; this is why we have insurance to replace our possessions, however insurance cannot replace that original envelope. The more precautions you take the more expensive, time consuming and inflexible this process becomes.
Is your current registration service giving value for money and flexibility?
One of the options iCreateditfirst provides is the ability for you to manage and view your uploaded works. By selecting the option, "View Protected Work" you have the ability to browse files you have time stamped and the information that you associated with them. You also have the ability to hide the files so only you can view and search on your protected data.

(Subscription service only) Additionally with the subscription service, you have the ability to delete files that you no longer want or need to protect. Why would you ever want to delete files? Surely that would invalidate evidence that may be subsequently required in court. You may be deleting old versions of your works, and therefore a later timestamp will be perfectly acceptable, or you may have sold the rights to your works. In this case you would not want to continue paying to protect something that is no longer yours.

Are existing services too inflexible and expensive?
With most current methods providing for copyright protection, no matter the size or the amount of work, there can be substantial costs applied in an inflexible manner.
iCreateditfirst allows you, the innovative individual, to select an account type and capacity that suits your needs. A lifetime account for permanent protection, or a subscription account to allow you to change the account capacity and works protected. This flexibility reduces the need to pay large amounts upfront without any immediate benefit.
What is iCreateditfirst Lifetime?
Unlike the current iCreateditfirst subscription annual model, the iCreateditfirst "lifetime" model means your work is registered, time stamped and protected for your lifetime (until the date of your death).
What happens to my work in the event of my death?
Ownership of the author or creator's work may be transferred at any time to the nominated Beneficiary, requested at the registration process, by presentation of a copy of the author or creator's death certificate. A different beneficiary nominated in the author or creator's Will, would take precedent over nominated iCreateditfirst Beneficiary on presentation of a copy of the Will. In both cases, the appropriate fee must be paid to complete the transfer.
How does iCreateditfirst know if I am alive or dead?
- In the event of no account activity or any kind for one year, iCreateditfirst will put the account into 'Identity Check' status.
When an account's status is marked as 'Identity Check', iCreateditfirst will send up to three emails, one per month, to the author or creator until a response is received. In the event of no response, iCreateditfirst will send a single email annually to the creator and your nominated beneficiary for a further two years. If the author or creator responds to any of these emails, the account will be returned to 'Active' status.
In the event of no response to any of the previous email reminders your account will be placed into a 'Beneficiary Check'. You will be informed of this in a postal reminder with your account details, excluding password. If there is a response to this postal reminder, the account can be returned to 'Active' status but there will be an administration charge for this.
Failure to respond to the postal reminder will result in the account being put into 'Beneficiary Status'.
When an account's status is marked as 'Beneficiary Status, iCreateditfirst will send an email to the beneficiary. In event of no response, a further email will be sent a year later. In the event of no response to this email after a further three months, a final email will be sent to the Beneficiary, explaining the available options.
The options available are:

   1. Notify the author or creator to re-activate the account by contacting iCreateditfirst.
   2. Take ownership of the author or creator's work by sending a copy of the death certificate and paying the appropriate fee.
   3. Close the account.

If there is no response from the Beneficiary to the final reminder after three months, iCreateditfirst will close the account and remove all of the registered works.

What does the named beneficiary of my work have to do to claim ownership of my work ?
When an account's status is marked as 'Beneficiary Check', iCreateditfirst will send an email to the Beneficiary. In event of no response, a further email will be sent a year later. In the event of no response to this email after a further three months, a final email will be sent to the Beneficiary, explaining the available options.
The options available are

   1. Notify the author or creator to re-activate the account by contacting iCreateditfirst.
   2. Take ownership of the author or creator's work by sending a copy of the death certificate and paying the appropriate fee.
   3. Close the account.

If there is no response from the Beneficiary to the final reminder after three months, iCreateditfirst will close the account and remove all of the registered works.

What is the file size limit for uploading ?
5MB. We believe this to be adequate based upon experience of existing PC compression mechanisms. If you feel that this is inadequate please send your comments to Feedback.
What is it meant by 5MB and how do I check my file size ?
The ‘MB’ stands for Megabytes. 5MB is the current file size limit. In order to check what your file size browse your current file system to the file and click on the properties to find out the file size. For example:



1 MB Mega Byte = 1024 (KB) Kilo Bytes or 1024 (KB) X 1024 for (1048,576 Bytes)
3 MB Mega Byte = 3072 (KB) Kilo Bytes or 3072 (KB) X 1024 for (3145,728 Bytes)
5 MB Mega Byte = 5120 (KB) Kilo Bytes or 5120 (KB) X 1024 for (5242,880 Bytes)

Your file size should not exceed the following Sizes:

  • How can I compress my files so that they are 5MB or less ?
    Users that are uploading music:

    Music users, there are a number of sites that allow you to promote your music online. These sites require uploading too and offer a great deal of advice for music file compression to MP3’s. Click on the following link for advice from mp3.com:

    A common method used for file compression is the utilisation of ZIPcompression. The amount of files that you include in a ZIP archive is up to you; please ensure that you do not exceed the 5MB file limit.

    Can I upload a ZIP file containing more than one file ?
    Yes, please ensure that your files in the ZIP Archive do not exceed the 5MB file limit and ensure that you describe in the description field of your upload the contents of your ZIP archive.
    What file types and information can I upload ?
    You can upload any file type and information where you wish to assert that ‘icreateditfirst’, however please read the Terms & Conditions
    Once I have clicked on the browse button to upload a file where is the file browser looking ?
    The file browser is looking on your local computer. Go to the file you require for uploading.
    What does upload mean ?
    The best way to understand uploading is to think about when you download a file from the web. When you download a file you are receiving a file from a remote server and creating a copy on your local PC. Uploading is the reverse of this, ie this is where you are taking a file from your local computer and making a copy on a remote server, in this case ‘icreateditfirst.com’ servers.
    I cannot upload my file, why ?
    If you are experiencing problems when uploading a file then we would suggest the following:
       
  • Check that you are still connected to the Internet.

  •    
  • Check that you are still connected to the Internet.

  • Ensure that the file you have selected is virus checked!

  •    
  • Please ensure that your file size is no bigger than 5MB.

  • If the file(s) is not zipped try zipping them for an optimised upload.

  • Try logging out and then login in again.

  • Try a different Web Browser. If you are using Internet Explorer, try using Netscape and vice versa.

    Upon completion of file upload you will be asked to confirm your upload. It is important to confirm your upload and verify that it was successful. Failure to do so could result in paying to protect corrupted work.
    What happens if I delete the wrong file ?
    Contact support@icreateditfirst.com immediately. Failure to do will result in the loss of your work and associated timestamp.
    Can I view my protected work?

    What is it meant by viewing my protected work?
    This where you can view the work you have uploaded to us. This is a unique service giving you flexibility and value for money.
    Can other people view my protected work, if so can I prevent them from doing so?
    Other people can view information about your protected work but not the contents of the file uploaded. You have the option to prevent anonymous browsing of the information about your work. Click here and select hide to prevent anonymous browsing

    Yes, the time stamp will apply to the current status of the files within Archive. NOTE: There are no restrictions on the file type/Format.
